Terms of Sale and Licence
These terms apply when you download, install, try or subscribe to Take-Off by WEQS (“the software”), made and sold by WE Quantity Surveyor (“we”, “us”), a quantity surveying practice in Kuala Lumpur, Malaysia. They take about five minutes to read.
The two points that matter most:
All sales are final. The complete software can be tried free for 30 days, and a licence key is delivered and usable at once, so we do not give refunds (section 5).
You are responsible for every quantity. The software measures what you trace at the scale you set; checking the scale and the figures before you use them is your professional work, not ours (section 7).
1. What you get
- A licence to use the software on one computer for the period you have paid for. You do not buy the software; you subscribe to use it. The licence is for you or your firm and cannot be resold, lent or shared.
- A licence key is tied to one machine id. To move to a new computer, click Remove from this machine in Help > Licence, send us the new machine id, and we issue a key for it at no charge. We may decline if machines change so often that a seat is plainly being shared.
- Every update we release during your subscription, and support by WhatsApp or email on Malaysian working days.
2. The free trial
- 30 days from the first start, every feature on, no payment, no card, no account. It exists so that you can decide before paying.
- When it ends the software becomes read-only, as described in section 6. Nothing you measured is lost.
3. Prices and payment
- Prices are the ones shown on the software page when you order: an introductory price for the first three months, then a monthly or a yearly subscription per seat. Prices are in US dollars, with a Malaysian ringgit equivalent for customers in Malaysia. We may change prices for future periods, never for a period you have already paid for.
- You pay by the method we agree with you when you order, such as bank transfer, e-wallet or card, as available. Your paid period starts on the day we issue the key or, when you renew, on the day your current period ends.
- Subscriptions do not renew by themselves. Nothing is charged without a new order from you. The software shows how many days remain, and we may remind you before a period ends.
- Prices include any Malaysian tax we are required to charge. Taxes, duties or bank charges of your own country are yours.
4. Delivery
- The key is sent by WhatsApp or email, normally the same working day and at the latest within two working days of payment.
- If we fail to deliver a working key within five working days of payment, you may cancel the order and we refund the full amount.
5. No refunds
- All sales are final. Because you can try the complete software free for 30 days before paying, and because a licence key is delivered and usable immediately, we do not refund or credit any period you have paid for. That includes when you stop using the software, change computers, or bought a longer period than you needed.
- The only exceptions are: (a) we cannot deliver a working key (section 4); (b) a key we issued does not activate on the machine it was issued for and we cannot put that right within seven days; (c) where the law of your country gives you a right that these terms cannot take away. Nothing in these terms reduces your statutory rights as a consumer.
- If you are a consumer in the United Kingdom or the European Union: by asking us to send the key at once, you agree that we begin supplying the digital content immediately, and you acknowledge that you lose the right to cancel within 14 days once that supply has begun.
6. When a subscription ends
- New measuring stops. Everything already measured stays open: you can read every quantity, save the project and export it to Excel or CSV for as long as you like.
- Subscribe again at any time to carry on measuring. There is no penalty and no lost work.
7. Your responsibility for quantities
- The software measures what you trace, at the scale you set for each sheet. You are responsible for setting and checking the scale of every sheet, and for checking every quantity, before you rely on it in a bill of quantities, an estimate, a tender, a claim, a valuation or a contract.
- We do not warrant that any quantity is correct, and we accept no liability for loss arising from a quantity, a scale, a drawing, or a decision based on them. A take-off is professional work; the software is a tool for doing it, and the professional judgement stays with you.
8. What you may not do
- Share, sell, lend or publish a licence key; run one key on more than one machine; work around, remove or reverse-engineer the licensing; decompile or modify the software beyond what the law expressly allows; or use the software to break the law or someone else’s rights.
- If you do, we may end your licence without refund, in addition to any other remedy we have.
9. Third-party components
- The software includes open-source components under their own licences, listed under Help > Third-party notices in the program.
- Reading DWG files uses the free ODA File Converter, which you install separately and use under its own terms.
10. Our liability
- To the extent the law allows, our total liability for anything arising from the software or these terms is limited to the amount you paid us in the twelve months before the claim, and we are not liable for loss of profit, business, contracts, data, or any indirect or consequential loss.
- Nothing limits a liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
- The software is supplied as described on the software page and in the user manual. Beyond that, and to the extent the law allows, it is supplied as it is, without other warranties.
11. Privacy
- What we collect and why is set out in the Privacy Notice. The software has no account and uploads nothing; your drawings and measurements stay on your computer.
12. Changes to these terms
- We may update these terms for future orders. The version in force when you order applies to that order. The current version, with its date, is always at wequantitysurveyor.com/terms.html.
13. Law
- These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute. If you are a consumer in another country you keep the protection of your own country’s mandatory consumer law and courts.
14. How you agree
- You agree to these terms by installing the software (the installer asks you to accept them), by requesting a licence key, or by paying for a subscription. If you do not agree, do not install the software and do not order a key.
